Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between you and Webdever ("we", "us", "our"). They apply to your use of webdever.com and any related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Webdever is a marketplace for apps built with AI. Creators can list apps they have made, and other people can find, share, buy, and download them.

We provide the platform. Unless we say otherwise, the apps listed on Webdever are made and owned by independent creators, not by us.

You must be at least 13 years old, and old enough to form a binding contract where you live, to create an account. If you use the Service for a business, you confirm you can bind that business to these Terms.

• Give accurate information and keep it up to date.
• Keep your password secret. You are responsible for activity on your account.
• Tell us promptly if you think your account was accessed without permission.

When you list an app or submit anything else to the Service ("Your Content"), you keep ownership of it. You give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content as needed to run and promote the Service.

You promise that:

• You own Your Content or have every right needed to list and distribute it, including any code, models, data, images, and open-source components in it.
• Your Content, including anything generated by AI, does not infringe anyone else's rights or break any law.
• Your Content does not contain malware, hidden tracking, or code meant to harm users or their devices.
• Your listing describes the app honestly, including what it does, what it costs, and what data it collects.

You are responsible for the licenses you grant to people who download your app and for supporting it.

Apps are provided by their creators under the license terms shown on each listing. We do not review every app in depth and we do not guarantee that any app is safe, accurate, secure, or fit for your purpose.

Review an app and its license before you install or run it, and use appropriate caution with apps that handle sensitive data. Any issue with an app is between you and its creator.

Browsing and listing an app are free unless we clearly state otherwise. Some apps may be paid. The price and any recurring charges are shown before you confirm a purchase.

Payments are handled by third-party payment processors. We do not store full card numbers. Refunds for paid apps follow the refund terms on the listing or, if none are stated, applicable law. We may change our own fees with notice before the change takes effect.

You agree not to:

• Upload malware or anything designed to damage, spy on, or gain unauthorized access to systems or data.
• List content that is illegal, deceptive, hateful, sexually explicit involving minors, or that infringes intellectual property or privacy rights.
• Scrape, overload, probe, or attempt to bypass security or rate limits on the Service.
• Create fake accounts, fake reviews, or manipulate rankings, downloads, or ratings.
• Impersonate another person or business, or misrepresent who made an app.
• Use the Service to send spam or to break any law that applies to you.

The Webdever name, logo, site design, and software are ours or our licensors'. These Terms do not give you any right to use them except to use the Service as intended.

If you believe content on Webdever infringes your copyright, email [email protected] with: a description of the work, the URL of the listing, your contact details, a statement that you act in good faith and that your notice is accurate, and your signature. We may remove content and, for repeat infringers, close accounts.

The Service may link to or connect with third-party services such as GitHub, payment processors, and creators' own websites. We do not control them and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.

You can stop using the Service and delete your account at any time from your account settings.

We may suspend or end your access, or remove content, if we reasonably believe you broke these Terms, created risk or legal exposure, or if we must do so by law. Where practical, we will tell you why. Sections that by their nature should survive termination, such as ownership, disclaimers, liability limits, and dispute terms, will survive.

THE SERVICE AND ALL APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some places do not allow certain disclaimers, so parts of this section may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

You agree to defend and indemnify us against claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of anyone's rights.

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. Courts located in Clark County, Nevada have exclusive jurisdiction over disputes, and you consent to that jurisdiction, except where your local consumer law gives you the right to bring a claim elsewhere.

We may update these Terms from time to time. If a change is material, we will give notice on the site or by email before it takes effect. If you keep using the Service after the effective date, you accept the updated Terms.
